Terms of Use

These Terms of Service (Terms) constitute a legally binding agreement between the website visitor and/or customer (You, Your) and SalonJL Pty Ltd ABN 25 649 303 195 Trading as Salon Jaimmelee (We, Us, Our). These Terms govern Your use of the Salon Jaimmelee website located at Salonjaimmelee.com (our Site) and the ordering, purchase, fulfilment and delivery of our products and services by Salon Jaimmelee.

By using the Site and/or purchasing our products and services, You acknowledge and agree that you have had a sufficient opportunity to read and understand these Terms and you agree to be bound by them. If you do not agree to be bound by these Terms, please do not continue to use the site, place any orders for our products, or purchase our services. These terms were last updated in June 2022.

Orders

Once an order for products on our Site had been confirmed, you cannot cancel it. All orders are subject to acceptance by Us, at our discretion.

 

Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), we will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your order information being incomplete or inaccurate or as a result of being unable to change or cancel your order once it has been accepted by us, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

You acknowledge that all products that you order are intended for personal, domestic, non-commercial use only.

 

Prices

All prices are in Australian dollars. Prices include GST unless indicated otherwise but exclude delivery charges and customs duty and other taxes, if applicable. All prices are subject to change without notice.

 

We reserve the right to change all appointment, product and service prices at any time without warning or further notice. Appointment prices may vary from client to client depending on service or product sold to or brought by the individual client based on their personalised needs.

 

Payment

The full payment for your order online (including the product price and applicable delivery charges) is deducted from your credit card on completion of your order. Delivery will commence once payment has been processed and validated. Large transactions may involve additional screening and we will require confirmation on key details before we proceed to fill the order. In this event, we will contact you. In some cases, this may delay your order for a short period.

 

We accept Eftpos, Visa, and MasterCard. We don’t accept bank cheques, American Express or offer AfterPay.

 

At Salon Jaimmelee we do not hold any personal client accounts, all appointments performed the day of the service must be paid in full that day.

 

If you fail to pay for your service the day of your appointment or leave the premises without payment or knowledge of the stylist, you will be banned from the Salon and all future appointments will be immediately cancelled and Salon Jaimmelee reserves the right to pursue the non-payment legally.

 

Delivery

Please read our Shipping Policy which forms part of these Terms of Service. Unless otherwise agreed, the products are not insured by us and you will bear any risk of loss or damage to the products when delivered to you.

 

Errors

From time to time there may be errors on our Site such as wrong pricing, wrong descriptions, and offers for products that are not available or are no longer available. Despite anything else in these Terms, to the extent legally permitted, We may decline or cancel any orders that are affected by the error, even if the order has been confirmed and a credit card charged. If Your credit card is charged for the purchase and We cancel the order, We will notify You and credit Your credit card account for the amount charged.

 

Intellectual Property

All material on our Site or otherwise delivered by Us, including but not limited to trademarks, logos, service marks, text, and graphics (Our Content), is subject to copyright. While You may browse Our Content for non-commercial, personal or internal business use, You must obtain our prior written permission if You’d like to use, copy or reproduce anything on our Site. Modification of Our Content for any other purpose is a violation of our copyright and other proprietary rights and is strictly prohibited. You acknowledge that You do not acquire any ownership rights by using our Site or Our Content. The trademarks displayed on our Site are registered or unregistered trademarks of SalonJL Pty Ltd and/or its directors and officers. The trademarks whether registered or unregistered, may not be used in connection with any product or service that does not belong to Salon Jaimmelee in any manner that is likely to cause confusion with customers, or in any manner that disparages Salon Jaimmelee. Nothing contained on our Site should be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark without our express written permission. The name of Salon Jaimmelee may not be used in any way, including in advertising or publicity pertaining to the distribution of Our Content without the prior written permission of Salon Jaimmelee. You agree that damages may be an inadequate remedy to a breach of these Terms and acknowledge that Salon Jaimmelee will be entitled to seek injunctive relief if such steps are necessary to prevent violations of its intellectual property rights.

 

Booking and Cancellation Policy

By making a booking, you agree to be bound by our booking and cancellation policy.

 

When you make your booking with Us for an in-salon service online, in person or by telephone, a deposit of $50.00 (Deposit) must be paid to confirm Your commitment to attending Your scheduled appointment and to protect Salon Jaimmelee's interest in the event of late cancellations or no-shows. The Deposit is non-refundable.

 

A notification reminder of your appointment with Salon Jaimmelee will be sent via email 3 days prior to your scheduled appointment.

 

You must arrive at Salon Jaimmelee at least 5 minutes before your scheduled booking time to ensure that your appointment runs for the full duration of the appointment and that the appropriate consent forms are completed for you.

 

If you attend your scheduled appointment as booked, the Deposit will be credited towards the cost of the service provided at your appointment.

 

If you are running late to your appointment, we reserve the right to cut short your appointment time to ensure that our stylists are not late for their following appointments. If you arrive 20 minutes or more after your scheduled appointment, your appointment must be rescheduled and in these circumstances the Deposit will be forfeited. You agree the Deposit amount is a genuine pre-estimate of the loss We would suffer should we have to cancel and re-schedule your appointment because you arrived late.

 

We understand that you may need to change your booking, and we kindly require that you provide us with a minimum of 48 hours to allow us enough time to offer that spot to another client. Please phone the salon on 0420419411 or email us at info@salonjaimmelee.com if you cannot make your booking and need to change it.

 

If you reschedule your appointment and give Us a minimum of 48 hours’ notice, the Deposit will transferred to the re-scheduled appointment for use as a credit towards the cost of the service provided at your re-scheduled appointment.

 

If You do not give us at least 48 hours’ notice to change or cancel your appointment, or are a “no show”, your Deposit will be forfeited. You agree this amount is a genuine pre-estimate of the loss We would suffer if you cancel your appointment without giving us at least 48 hours’ notice. 

 

Please note that if your booking relates to an event or other service outside the salon, a different booking and cancellation policy will apply.

 

Thank you for being a valued client and for Your understanding and cooperation with this policy. It will enable us to open otherwise unused appointments to better serve the needs of all Salon Jaimmelee clients.

Ethics Policy

Salon Jaimmelee's ethics policy has been put in place so that our staff can exercise discretion in applying the Booking and Cancellation Policy in unfortunate and unforeseen circumstances; this involves things such as a personal injury that prevents clients from getting to appointments, any other potential emergencies that are genuine and prevent clients from attending, or death, debilitating sickness or disease.

 

Examples of situations that are NOT unfortunate and unforeseen circumstances and will result in your Deposit being forfeited include but are not limited to:

 

·       Forgetting appointments or "no showing".

·       Last-minute work roster changes.

·       Mis-managing schedules or double booking.

·       Running late and missing your appointment.

·       Mild sicknesses such as colds/flu that does not prevent clients from attending work/events (we exercise caution & provide sufficient barriers to clients and staff).

 

We do our best to accommodate last-minute changes, however because of the high demand for our stylists we only provide a small window for genuine circumstances.

 

Our Site and Your use

We have made reasonable endeavours to ensure that the information and content provided on our Site is accurate and current at the date of publication, and that the photographs of the products listed on the website are represented accurately (including the size, colour, texture and overall appearance of the product and the colour and shades offered by the products). However, you acknowledge and agree that: (a) the effect and texture of the products may appear different in real life in comparison to the images displayed on our Site; (b) the size of the products may appear different in real life in comparison to the images displayed on our Site, for example, the product may appear smaller or bigger than their actual size; (c) the fill level of the product may appear higher or lower than the fill level of the product displayed on our Site (where applicable); (d) information in relation to certain products may have been inaccurately described by our suppliers which we have relied upon and undertaken reasonable inspections, which would normally be expected in the course of business to verify the information; and (e) to the extent permitted by law, we provide no (whether implied, expressed or otherwise) warranties, representations, or guarantees of any kind in relation to information, content and photographs on our Site.

You are welcome to create links from Your website or social media account to our site provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. Our Site may contain links to sites not owned or operated by Salon Jaimmelee. Any links to third party sites on ours are purely for information purposes only and for your convenience. By no means does this indicate that we endorse, sponsor, affiliate or recommend any products, services or content within third party sites and solely exclude ourselves from any liability associated with their site content, its owners or its providers. It is Your personal responsibility to ensure that any information on products or services available on our Site meets Your specific individual needs and We take no responsibility for the misuse of this information.

You acknowledge that we are not responsible for the accuracy of the information contained in these third party websites and we do not endorse any features, content, advertising, products or any other materials, and such information does not form part of our content. You should review any applicable terms and the privacy policy of a third party website before using that website or providing any information. You agree and acknowledge that you access and use third party websites entirely at your own risk.

Warranties

Nothing in these Terms excludes, restricts or modifies the application of any legislation which by law of any jurisdiction cannot be excluded, restricted or modified. In particular, without limiting the foregoing, where you are considered a “consumer” within the meaning of the Australian Consumer Law (ACL), we give the guarantees to the extent required by the ACL (Consumer Guarantees) with respect to our products and services.

 

Limitation of liabilities

Where by law we are unable to exclude terms, guarantees, warranties, representations or conditions but are able to limit them, to the extent permissible by law we limit our liability for any breach (including for any Consumer Guarantees), at our option, to the repair or replacement of products or fixing the problem with the service, or payment of the cost of repairing or replacing the products, a refund of the price paid for the products or provide compensation for the drop in value below the price paid for the services, or a refund of the price paid for the services.

We will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the product or services or these Terms, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

To the extent permitted by law, our total liability arising out of or in connection with the products or services under these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the total price paid by you for the purchase of products and/or performance of the services under these Terms.

General

These Terms are governed by the laws of Western Australia, Australia. The parties each agree to submit to the non-exclusive jurisdiction of the courts of Western Australia, Australia. We may change any provision in these Terms without notice. Any updated Terms will be published on our Site and will only apply to orders submitted and/or services performed after the updated Terms are published.

You must not assign any rights and obligations under these Terms whether in whole or in part without our prior written consent.

Any notice in connection with these Terms will be deemed to have been duly given when made in writing and delivered or sent by email or post to the party to whom such notice is intended to be given or to such other address or email address as may from time to time be notified in writing to the other party.

If any provision of these Terms is invalid, illegal or unenforceable, these Terms of Service take effect (where possible) as if they did not include that provision.

Any failure by a party to insist upon strict performance by the other of any provision in these Terms will not be taken to be a waiver of any existing or future rights in relation to the provision.

If a dispute arises under these Terms, neither of You nor Us may bring court action against the other (other than proceedings seeking urgent interlocutory relief) without first attempting to resolve the info@salonjaimmelee.com to seek a resolution. Any reasonable requests will be considered and Salon Jaimmelee will attempt to resolve the dispute through alternative dispute resolution procedures.
